Terms of Service
These Terms of Service ("Terms") govern your use of Smart Abode — including our mobile applications, the smartabode.app website, and any associated features (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Smart Abode helps you track and manage maintenance for your properties: appliances, home systems, vehicles, yard equipment, and the recurring tasks that keep them working. The Service includes free features and optional paid subscriptions.
2. Your Account
- You must provide accurate information when creating an account and keep your credentials secure. You are responsible for activity under your account.
- You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service.
- You may delete your account at any time from Account Settings. Deletion is permanent and removes your account, properties only you own, and their maintenance history.
3. Subscriptions and Billing
- Paid plans are billed through the App Store, Google Play, or our web billing provider. Pricing and plan details are shown before you subscribe.
- Subscriptions renew automatically until cancelled. Cancel any time through the store or billing provider you subscribed with; access continues until the end of the paid period.
- Deleting your account does not cancel a store subscription — cancel it in the App Store or Google Play first.
- Refunds are handled by the store or billing provider under their policies.
4. Your Content
You retain ownership of the content you add to the Service — property details, tasks, notes, photos, and documents. You grant us the limited license needed to store, process, and display that content to you and the people you share your properties with. You are responsible for having the rights to anything you upload.
5. Sharing and Groups
The Service lets you share properties with other people through groups. Members you invite can see and, depending on the role you give them, change property data. You control your group's membership; review it periodically.
6. Acceptable Use
You agree not to:
- use the Service for any unlawful purpose or in violation of these Terms;
- upload malicious code or content you don't have the right to share;
- attempt to gain unauthorized access to the Service, other accounts, or our systems;
- interfere with or disrupt the Service, including by circumventing rate limits;
- resell, scrape, or bulk-extract the Service or its data without our written consent.
7. Maintenance Guidance Disclaimer
All maintenance tasks, schedules, and step-by-step instructions provided in the Service are recommendations only. Always refer to the original equipment manufacturer's (OEM) documentation and to qualified professionals for the definitive maintenance requirements and safety requirements that apply to your specific equipment.
Maintenance schedules, task descriptions, how-to content, and recommendations in the Service are general guidance only. They are not professional advice and may not fit your specific equipment, conditions, or local codes. Always follow the manufacturer's documentation and applicable safety regulations, and hire qualified professionals where required. You are solely responsible for work you perform on your property and equipment.
8. Affiliate Links and Advertising
The Service may show advertising and may link to third-party retailers for parts and supplies, including through affiliate programs that pay us a commission. We are not a party to your purchase from any third party and are not responsible for their products, pricing, or policies.
9. Intellectual Property
The Service, including its software, design, and content we provide (excluding your content), is owned by Smart Abode and protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable license to use the Service per these Terms.
10. Termination
You may stop using the Service or delete your account at any time. We may suspend or terminate accounts that violate these Terms, create risk for other users, or where required by law. Where practical, we will notify you and give you a chance to export your data.
11. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data will never be lost — keep independent records of information you cannot afford to lose.
12. Limitation of Liability
To the maximum extent permitted by law, Smart Abode will not be liable for indirect, incidental, special, consequential, or punitive damages, or for property damage, equipment failure, or personal injury arising from maintenance you perform or defer. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim or fifty US dollars ($50).
13. Changes to the Service or Terms
We may modify the Service or these Terms. For material changes we will update the "Last updated" date above and, where appropriate, notify you in the app or by email. Continuing to use the Service after changes take effect constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of the United States and the state in which Smart Abode operates, without regard to conflict-of-law rules. Disputes will be resolved in the courts of that jurisdiction unless applicable law provides otherwise.
